Abstract
:
The subject of the study deals with the offenses committed via the publication of printed matter, possibility of bringing balance between freedom of the press and protection of others’ rights and freedom that are infringed by the publication of printed matter, and clarification of the criminal liability resulting from offenses committed via the publication of printed matter according to the Saudi Arabian Law of Printed Materials and Publication (LPMP). The argument covers the concept of freedom of the press, its guarantee and restrictions, definition of criminal offenses of the press according to the Saudi Arabian Law, its legal nature, elements and characteristics. It also states the types of offenses that are infringed via the press printed materials, the authority to examine cases of printed media offenses, and procedural terms resulting from committing related offenses in accordance with the recent LPMP Amendment of 20/05/1432H. It also states the penalties taken against LPMP offenders, whether press establishments or their staff or media workers, so that they take caution not violate the Law. The most significant result that the study discusses is that the freedom of press is to be practiced with responsible freedom, to protect the public interest and others’ rights and freedom. It concludes that a press criminal offense is considered of public nature, which is distinct from other offenses of similar type by its means. This condition is of an aggravating circumstance. It also clarifies that the criminal responsibility in the press media offenses is exceptional, because of the mass number of collaborators in the press and their overlapping responsibility.
