The foundation of bankruptcy is not to be considered a crime punishable by law; however, this bankruptcy may be accompanied by certain acts and actions that may occur from the bankrupt, the creditor or others, and cause the bankruptcy to become a crime punishable by the legislator. Bankruptcy crimes occur within the range of money crimes that affect the increase of turmoil and reduce confidence and destabilization of credit in the commercial environment of States. The Saudi legislator issued the bankruptcy system in 1439 AH and all the articles that dealing with bankruptcy crimes have been changed. In this sense, the studys problem was to identify bankruptcy crimes in the Saudi regime. The study aims to clarify the types of bankruptcy crimes and indicate who is committing them and clarify the elements of each crime. The study is based on a comparative analytical approach, according to the analysis of texts, clarification and comparison with the laws of other countries, to find out what distinguishes it, and the weaknesses it have. This study is divided into three chapters, chapter one clarifying the concept of bankruptcy crimes, and then chapter two dealt with the elements of fraud and default bankruptcy, while chapter three dealt with other bankruptcy crimes of crimes of creditors and crimes of persons outside bankruptcy.
